The Lovevery Tiny Footprints Giveaway Official Rules

Purpose. These Lovevery Tiny Footprints Giveaway (the “Rules”) govern the Lovevery Tiny Footprints Giveaway (the “Giveaway”). By entering the Giveaway, you agree to be bound by these Rules.

Sponsor.

The Sponsor of the Giveaway is Lovevery, Inc. (“Sponsor”). The Giveaway is not sponsored or administered by any other company (including, without limitation, Instagram and Facebook, which also are not associated with and do not endorse this Giveaway). Several other companies are providing prizes for the Giveaway, and you may be able to enter the Giveaway by taking particular actions with some of these companies as described in these rules;

these companies are referred to in these Rules as “Participating Brands.” By entering the Giveaway, you agree to release Instagram and Facebook of any obligation, expectation, claim, or liability of any kind in connection with your entry or the Giveaway.

Binding Agreement. In order to enter the Giveaway and to receive a Prize, you must agree to the Rules. Therefore, please read these Rules prior to entry to ensure you understand and agree.

Eligibility. To be eligible to enter the Giveaway, you must be at least eighteen (18) years old and a legal resident in the continental United States. Immediate family members (i.e., parents, children, spouses or partners, grandparents, grandchildren, aunts, uncles, nieces or nephews) of Sponsor or of any Participating Brands are not eligible to participate in the Giveaway. The Giveaway is void in Alaska, Hawaii and Rhode Island where prohibited by law.

Participating Brands and Media Partners. The Participating Brands include each of the following: Lovevery, Solly Baby, Esembly, Design Dua, Lettuce Grow, Bumbleride, Ten Little, Pipette, Nestig, Upchoose, Mini Magazine

How to Enter. Participation in the Giveaway is voluntary and does not require you to purchase anything from Sponsor. You can enter the Giveaway in one or more of the following ways:

1. Sign up for the Lovevery and participating brands (see above) email newsletters by visiting https://lovevery.com/community/blog/tiny-footprints (the “Giveaway Website”) and following the instructions available there. This will result in one (1) entry. You are limited to one entry using this method.
2. Send a 3” by 5” card containing your name, email address, and phone number to Sponsor at Lovevery, 918 West Idaho Street, Boise, ID 83702, Attn: Andrea Erb, with “Lovevery Only the Best for Baby Giveaway” on the card. Each mailed card received during the Giveaway Period will result in one (1) entry. Cards received after the Giveaway Period will be discarded and not entered. 

All entries must be complete (and, if applicable, received) during the Giveaway Period.

NO PURCHASE IS NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

Giveaway Period. The Giveaway begins on Monday, April 19th at 12:00 AM mountain time, and ends on Thursday, April 22nd at 11:59 PM mountain time (the “Giveaway Period”). The time for the Giveaway Period shall be determined by Sponsor’s computer. All dates are subject to change.

Selection and Notification of Winners. An entry will be selected as a potential winner by random selection from entries that comply with these Rules on after the Giveaway Period. The potential winners will be notified by Sponsor via e-mail, during the week of April 19th, 2021. The potential winner is subject to validation and verification of eligibility and compliance with these Rules, and may be required to provide additional information and to sign and return a liability release, publicity release, and/or tax-related documents. The potential winners must respond to the notification and provide all requested information and signed documents within forty eight (48) hours, or else the potential winner may be disqualified and Sponsor may select another winner. If the potential winners meet these and the other requirements of these Rules, they will be the winners (“Winners”). Decisions by Sponsor are final and binding.

Winners Announcement. The name of the Winners will be available upon request to andrea@lovevery.com for ninety days after the end of the Giveaway Period.

Prize. Each Winner will receive a prize that includes:

A 1 year subscription to Lovevery Play Kits (up to $480.00), a Solly Baby Gift Card ($150.00), an Esembly Gift Card ($150.00), a Design Dua Gift Card ($150.00), a Lettuce Grow Gift Card ($350.00), a Bumbleride Era Reversible Stroller ($659.00), a Ten Little Gift Card ($150.00), a Pipette Gift Card ($150.00), a Nestig Crib ($599.00), and an Upchoose Gift Card ($150.00). 

The items included in the prize will be shipped to you by the respective companies listed above. Sponsor is not responsible for shipping or fulfillment.

No transfer, substitution or cash equivalent for prizes is allowed, except at Sponsor’s and Participating Brands’ sole discretion. Sponsor and the Participating Brands each reserve the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason.

Odds of Winning. Odds of winning the Giveaway will depend on the number of entries received during the Giveaway Period.

Taxes. The Winner is solely responsible for all federal, state, and local taxes associated with receipt and use of the prize.

General Conditions. All federal, state, and local laws and regulations apply and Giveaway is void where prohibited by law. Sponsor reserves the right to disqualify any entry from the Giveaway if, in Sponsor’s sole discretion, it reasonably believes that the entry resulted from an attempt to undermine the legitimate operation of the Giveaway by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants or Sponsor. Entries using automated means are prohibited.

Privacy. You agree that personal data submitted with an entry, including name, e-mail address, zip code, due date and child’s birthdate may be collected, processed, stored, and otherwise used by Sponsor, Participating Brands, and their affiliates for the purposes of conducting and administering the Giveaway. You also agree that any personal data submitted by you in connection with an entry will also be used in connection with Sponsor’s and Participating Brands’ promotional, marketing, and advertising activities. Without limitation, Sponsor and Participating Brands may use your personal information to send you updates on themselves and their products, as well as promotional materials, from time to time. Release, Indemnification, and Disclaimer of Warranties. By entering, and to the maximum extent permitted by law, you agree to release, defend, indemnify and hold harmless Sponsor, the Participating Brands, and their employees, officers, directors, and agents from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, fines, and costs and expenses (including, without limitation, reasonable attorney fees) arising out of or relating to: (i) any misrepresentation you make in connection with the Giveaway; (ii) any non-compliance by you with these Rules; (iii) claims brought by persons or entities other than the parties to these Rules arising from or related to Entrant’s entry or involvement with the Giveaway; (iv) acceptance, possession, misuse or use of any prize or participation in any Giveaway-related activity or participation in the Giveaway; (v) any malfunction or other problem with Instagram, Facebook, or Sponsor’s e-mail or computer systems in relation to the entry and participation in the Giveaway by you; (vi) any error in the collection, processing, or retention of entry in relation to the entry and participation in the Giveaway by you; or (vii) any typographical or other error in the printing, offering or announcement of any prize or winners in relation to the entry and participation in the Giveaway by you.

You further agree to release, defend, indemnify, and hold harmless Sponsor and its employees, officers, directors, and agents from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, injuries, fines, and costs and expenses (including, without limitation, reasonable attorney fees) arising out of or relating in any way to: (i) any prize provided by any other Participating Brand or the use or misuse of any such prize; (ii) the handling, mishandling, or sale of your personal data by any other Participating Brand. Sponsor does not provide and hereby expressly disclaims any warranties of any kind (including, without limitation, warranties regarding the condition, safety, or fitness for a particular purpose) regarding any prize manufactured by or provided by any other Participating Brand.

Sponsor reserves the right, in its sole discretion and without prior notice, to suspend or cancel any Giveaway or alter the rules for any reason, including but not limited to alteration or corruption of the administration of the Giveaway by computer virus, technical problem, or other unforeseeable event.

Forum and recourse to judicial procedures.

These Rules shall be governed by, subject to, and construed in accordance with the laws of the State of Idaho (without regard to its choice of law provisions). You acknowledge and agree that any action relating to or arising from these Rules or the Giveaway shall be commenced and conducted only in a federal or state court with subject matter jurisdiction in Ada County, Idaho. You hereby waive any personal jurisdiction challenges and waive any arguments based on forum non conveniens.

Miscellaneous. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. The party prevailing in any suit seeking the interpretation or enforcement of any provision of the Rules shall recover its reasonable attorneys’ fees incurred.
